1. Agreement to these Terms
These Terms of Service (the “Terms”) form a binding agreement between you and Ramyo Labs L.L.C-FZ (“Ramyo Labs”, “we”, “us” or “our”) and govern your access to and use of the WinedUp mobile application, related websites, and any other services we make available (together, the “Service”).
By downloading, installing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Who we are
The Service is operated by Ramyo Labs L.L.C-FZ, a free-zone limited liability company registered in Dubai, United Arab Emirates, with its registered office at Meydan Grandstand, 6th floor, Meydan Road, Nad Al Sheba, Dubai, U.A.E.

3. Eligibility
WinedUp is an adult party game that involves themes of alcohol consumption. You may use the Service only if you are at least eighteen (18) years old, or the legal drinking age in your jurisdiction if higher, and are legally permitted to use the Service where you live.
By using the Service you represent and warrant that you meet these requirements. The Service is not directed to, or intended for use by, minors.
4. Your account
To use certain features you may need to create a profile. You agree to provide accurate information, to keep your device and any credentials secure, and to be responsible for all activity that takes place under your account or on your device.
Please notify us promptly at support@tamoxa.com if you suspect any unauthorized use of your account.
5. License to use the Service
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to download and use the Service on devices you own or control, solely for your personal, non-commercial entertainment.
6. Acceptable use
You agree that you will not, and will not attempt to:
- use the Service in any way that is unlawful, harmful, abusive, harassing, defamatory, or that infringes the rights of others;
- reverse engineer, decompile, disassemble, or otherwise try to extract the source code of the Service, except where this restriction is prohibited by applicable law;
- modify, adapt, translate, or create derivative works based on the Service or any of its content;
- use any automated means (bots, scrapers, crawlers) to access the Service or interfere with its normal operation;
- attempt to bypass any security, age-gating, or rate-limiting mechanism, or use the Service if you do not meet the eligibility requirements;
- share, sell, rent, lease, or otherwise grant others access to your account or any paid content;
- upload or transmit content that contains malware, exploits, or any code designed to disrupt the Service.
7. User content
The Service lets you submit certain content, such as a display name, an avatar image, and gameplay inputs (together, “User Content”). You retain ownership of your User Content.
By submitting User Content, you grant Ramyo Labs a worldwide, royalty-free, non-exclusive license to host, store, reproduce, and display that content solely for the purpose of operating and providing the Service to you and your party participants. You represent that you have all rights necessary to grant this license and that your User Content does not violate the rights of any third party or any applicable law.
We may remove User Content that we reasonably believe violates these Terms or applicable law.
8. In-app purchases and subscriptions
The Service may offer optional one-time purchases or subscriptions (for example, content packs or premium features). All purchases are processed by the Apple App Store and are subject to Apple’s terms and policies, in addition to these Terms.
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the period ends. You can view, manage, and cancel your subscriptions at any time from your Apple ID account settings on your device. Refund requests are handled by Apple in accordance with their policies.
We may change pricing, availability, and the contents of any paid offering at any time. Where prices change for an ongoing subscription, we will give you reasonable notice and you may cancel before the change takes effect.
9. Responsible drinking and safety
WinedUp is a social party game whose content references and encourages voluntary alcohol consumption among adults. Drinking alcohol carries real health and safety risks.
You agree to use the Service responsibly. In particular:
- know your personal limits and stop whenever you want;
- never pressure anyone to drink, and respect anyone who chooses not to;
- never drive, operate machinery, or perform any activity that requires sobriety while under the influence;
- do not use the Service if you are pregnant, are taking medication that interacts with alcohol, have a medical condition affected by alcohol, or are otherwise advised not to drink;
- do not play with anyone who is underage or who has not freely chosen to participate.
The Service is provided for entertainment only. It is not a source of medical, health, or safety advice. You play entirely at your own risk and are solely responsible for your choices.
10. Intellectual property
The Service, including the WinedUp name and logo, the visual design, the wordmark, all prompts, packs, copy, sounds, and other content we make available (other than User Content), are owned by Ramyo Labs L.L.C-FZ or its licensors and are protected by intellectual property laws. Except for the license expressly granted in Section 5, no rights are transferred to you.
11. Third-party services
The Service relies on third-party platforms and services, including the Apple App Store, Apple Push Notification service, and our hosting and infrastructure providers. Your use of those services is governed by their own terms and privacy policies, which we do not control.
12. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, in whole or in part, at any time and without prior notice if we reasonably believe you have breached these Terms or applicable law, or if continued provision of the Service would expose us or other users to legal or safety risks.
On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will continue to apply.
13. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.
We do not warrant that the Service will be error-free, secure, or available at any particular time, or that defects will be corrected.
14. Limitation of liability
To the maximum extent permitted by applicable law, Ramyo Labs and its directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of (or inability to use) the Service.
To the maximum extent permitted by applicable law, our total aggregate liability for any claims arising out of or in connection with the Service or these Terms will not exceed the greater of (a) the total amount you paid us for the Service in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) fifty US dollars (USD 50).
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by applicable law.
15. Indemnification
You agree to defend, indemnify, and hold harmless Ramyo Labs and its officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your use or misuse of the Service, (b) your User Content, or (c) your breach of these Terms or of any applicable law.
16. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. If the changes are material, we will give you reasonable advance notice through the Service or by contacting you at the email address associated with your account.
Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree, you should stop using the Service.
17. Governing law and disputes
These Terms and any dispute arising out of or in connection with them or the Service are governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates, without regard to conflict-of-laws principles.
You and Ramyo Labs agree to submit to the exclusive jurisdiction of the competent courts of the Emirate of Dubai, United Arab Emirates, for the resolution of any such dispute, unless mandatory consumer protection laws in your country of residence give you the right to bring proceedings in your local courts.
